In response to inquiries from member districts, School & College Legal Services of California recently issued a Legal Update regarding who may consent for a student to be tested for COVID-19.
In summary, guidance from the California Department of Public Health (CDPH) indicates that students ages 13 and older may consent to testing without parental consent being required. Students under 13 may only be tested with parental consent.
